What is the application process?
Once we have obtained your completed application, we will send you a summary of the information we will lodge with the Trade Mark Office. Once you have reviewed that information you may ask us to proceed with the application or amend the information in the application.
There is a government fee for each separate trade mark application and a further fee for each additional class for each trade mark application which will need to be paid with the trade mark application. It may be possible to obtain a discount on the usual government fee for making an application if we are able to use the standard form goods and services pick list available in the online process. Where possible, we will use that mechanism but will advise you if that would require us to use a different description of goods or services than identified by you.
The Trade Marks Act 1995 allows you 15 months from the date of the examiner's first report in which to meet any requirements identified by the examiner and to have your application accepted by the Registrar. If you need additional time, you may request and pay for extensions of time.
If your trade mark application is not accepted and it runs out of time, it will lapse. As part of our service we will keep you properly informed of any impending deadlines (you can also track the progress of your application view our online portal, found in your customer portal) but please keep in mind the extra cost and difficulties involved in obtaining extensions of time.
